Frequently asked questions

Are reserve studies required by law?

It depends on the state and on the type of association. Some states require a reserve study on a set schedule, some require it only for certain buildings or association types, and many have no statewide requirement. Governing documents and lenders can require one even where the law does not.

Why are some states marked "Under review"?

We publish a state only after its research has been checked a second time against the text of the statute and signed off. Where a detail could not be confirmed, the page says so instead of guessing, and a state whose main answer could not be confirmed is not listed.

Is this legal advice?

No. This is general information. Laws change, and how they apply depends on your association. Confirm requirements with your association's attorney.

What if my state has no requirement?

A reserve study is still the standard way to plan for major repairs and replacements. Boards have a duty to manage the association's finances with care, and a current study is the usual evidence that they did.
